1. About These Terms & Conditions

These Terms and Conditions apply to all quotations, estimates, orders and services provided by Crescent Industrial Flooring (“we”, “us”, “our”).

By accepting a quotation, instructing us to carry out work, making payment towards an order or allowing work to commence, the customer (“you”, “your”, “the customer”) agrees to be bound by these Terms and Conditions.

These Terms and Conditions apply to services including, but not limited to, resin flooring, resin screeds and coatings, resin-bound driveways and patios, resin car parks, comfort resin flooring, rapid-dry screeds, polyurethane screeds, floor preparation, cleaning, repairs and associated flooring works.

Where a written quotation or contract has been provided for a particular project, the quotation or contract should be read alongside these Terms and Conditions. In the event of a conflict, the specific written agreement will take precedence to the extent of that conflict.

2. Quotations & Estimates

All quotations are based on the information available to us at the time of quotation.

Unless otherwise stated in writing, quotations are valid for the period specified on the quotation. We reserve the right to amend a quotation where there are changes to the project requirements, site conditions, quantities, materials, access arrangements or other circumstances outside our reasonable control.

Our quotation may include assumptions regarding the condition, suitability and preparation of the existing substrate. If the condition of the substrate differs materially from the information provided or reasonably apparent at the time of quotation, additional preparation or remedial work may be required.

Any additional work or materials required as a result of unforeseen site conditions may be charged separately.

3. Site Conditions & Existing Substrates

The successful installation and long-term performance of resin flooring, coatings and screeds depends significantly on the condition and suitability of the existing substrate.

Before work commences, we may assess the substrate to determine its suitability for the proposed flooring system. However, unless expressly agreed in writing, we cannot be responsible for defects, weaknesses or conditions within the existing substrate that are not reasonably identifiable during our assessment.

We reserve the right to delay or refuse installation where we reasonably believe that site or substrate conditions are unsuitable for the proposed system.

4. Porous Concrete, Outgassing & Pinholes

Resin flooring and coating systems are affected by the condition and porosity of the underlying substrate.

Where a concrete slab, screed or other substrate is porous, contains air voids or has residual moisture or trapped air, gases or air may migrate through the substrate during or after application. This process, commonly referred to as outgassing, can result in pinholes, small bubbles, blistering or other minor surface imperfections appearing in the finished coating.

The presence of pinholes, small air bubbles or similar imperfections caused by the substrate does not automatically constitute defective workmanship.

Where reasonably practicable, we may take measures intended to minimise the risk of outgassing and associated surface imperfections, including appropriate preparation, priming or application methods. However, we cannot guarantee that such imperfections will not occur where they arise from the characteristics or condition of the underlying substrate.

Where the customer has been informed of a substrate-related risk before installation, the customer accepts that such conditions may affect the final appearance of the flooring system.

If pinholes, bubbles or similar imperfections occur, we will assess the issue and, where appropriate, discuss reasonable remedial options with the customer. Any remedial works required solely because of unsuitable, porous, damp, defective or otherwise compromised substrate conditions may be chargeable.

5. Colour, Finish & Appearance

The customer acknowledges that variations in colour, shade, texture, aggregate distribution, gloss level and finish may occur due to lighting, application conditions, substrate characteristics, batch variations, environmental conditions and the nature of the materials used.

Minor cosmetic variations or imperfections that do not materially affect the performance, durability or intended use of the flooring system will not, by themselves, constitute a failure to provide the agreed service.

6. Access & Site Requirements

The customer must provide suitable access to the site and ensure that the agreed working area is available when required.

The customer must also ensure that the area is reasonably safe and suitable for our personnel and equipment.

7. Curing & Use of Newly Installed Flooring

The customer must comply with all instructions provided regarding curing times, access, cleaning and use of the newly installed flooring.

The flooring must not be subjected to pedestrian traffic, vehicles, heavy equipment, chemicals, water, cleaning products or other loads before the agreed or specified curing period has elapsed.

We are not responsible for damage caused by premature use, inadequate protection, other contractors, contamination or failure to follow our aftercare instructions.

8. Completion & Inspection

Upon completion, the customer should inspect the works as soon as reasonably practicable.

Any concerns regarding workmanship or the finished installation should be reported to us promptly and in writing, together with photographs or other relevant information where appropriate.

Where a defect or concern is reported, we will be given a reasonable opportunity to inspect the flooring and, where appropriate, carry out remedial work.

The customer must not appoint another contractor to carry out remedial works relating to alleged defects without first giving us a reasonable opportunity to inspect and address the issue, except where immediate action is reasonably necessary to prevent further damage.

9. Payment Terms

Payment terms will be stated on our quotation, invoice or written agreement.

Unless otherwise agreed in writing, invoices must be paid by the due date shown on the invoice.

The customer may not withhold, deduct, set off or delay payment of an invoice because of an alleged defect, snagging item or other dispute unless the amount being withheld reasonably relates to the specific matter in dispute and the customer has notified us promptly in writing.

Where only part of an invoice is genuinely disputed, the undisputed balance remains payable by the original due date.

We reserve the right to suspend further work where an invoice remains unpaid after its due date, without accepting liability for any resulting delay or consequences.

10. Late Payment & Interest

If payment is not made by the due date, we reserve the right to charge interest on overdue amounts. Interest may continue to accrue until the outstanding balance is paid in full.

Where an invoice remains unpaid after the due date, we reserve the right to take reasonable steps to recover the outstanding amount. This may include issuing payment reminders, suspending services, referring the debt for collection or commencing appropriate legal proceedings.

11. Disputed Invoices

If you believe an invoice is incorrect, you must notify us in writing as soon as reasonably practicable, clearly explaining the reason for the dispute.

A general refusal to pay, without providing details of the alleged issue, will not be considered sufficient notice of a genuine dispute.

12. Liability

We will carry out our services with reasonable care and skill.

Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, we will not be responsible for losses arising from pre-existing defects, structural movement, substrate failure, moisture ingress, third-party work or other circumstances outside our reasonable control.

Where legally permissible, we will not be liable for indirect or consequential losses, loss of profit, loss of business, loss of revenue or loss of opportunity.

13. Cancellation

Any cancellation of agreed works must be notified to us in writing.

Where materials have already been ordered, work has commenced, labour has been allocated, or costs have been incurred, the customer may be responsible for reasonable costs arising from cancellation, subject to applicable law and the terms of the individual contract.

14. Complaints

We encourage customers to contact us promptly if they have any concern regarding our work. Complaints should be submitted in writing and should provide sufficient information for us to investigate the matter.

15. Website & General Information

Information provided on our website is for general information purposes and does not form part of a specific contract unless expressly incorporated into the customer’s quotation or written agreement.

Specifications, images, photographs and descriptions are intended to indicate our services and may vary according to individual project requirements.

16. Governing Law

These Terms and Conditions and any contract between Crescent Industrial Flooring and the customer shall be governed by the laws of England and Wales.

Subject to any applicable consumer rights, the courts of England and Wales shall have jurisdiction in relation to any dispute arising from these Terms and Conditions or the services provided.

17. Amendments to These Terms

We reserve the right to amend these Terms and Conditions from time to time. The Terms and Conditions applicable to a particular project will be those in force and agreed at the time the contract is entered into, unless otherwise agreed in writing.
